2. Copyright Ownership and Use

All content published on Global Indian Network, including but not limited to text, images, graphics, logos, videos, audio, and software (collectively, “Content”), is either owned by us, licensed to us, or used under fair use provisions of applicable copyright law. Unauthorized reproduction, distribution, modification, or commercial use of our content is strictly prohibited and may result in legal action.

3. Use of Third-Party Content

We take all reasonable steps to ensure that any third-party content displayed on our platform is either:

  • Used under applicable copyright exceptions such as fair dealing (news reporting, criticism, research, etc.),
  • Incidental to the primary content, as permitted under Section 31 of the UK Copyright, Designs and Patents Act 1988.

4. DMCA Notice of Alleged Infringement (UK & International Procedures)

If you are a copyright owner or an authorized representative and believe that any content hosted by Global Indian Network infringes your copyright, you may submit a takedown request. Your notice must include:

  • Identification of the copyrighted work(s) claimed to be infringed,
  • Identification of the allegedly infringing content, including its location on our website,
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law,
  • A statement, under penalty of perjury, that the information provided is accurate and that you are the copyright owner or authorized to act on the owner’s behalf,
  • Your name, physical address, email, and phone number,
  • A physical or electronic signature.

5. Response to Takedown Notices

Upon receiving a valid notice, we will:

  • Review the complaint in accordance with UK copyright law,
  • Determine whether the claim meets the legal threshold for infringement,
  • Notify the content provider and allow them to submit a counter-notice if they believe the claim is unfounded.

We reserve the right to reject takedown requests that:

  • Fail to provide sufficient legal evidence of copyright ownership,
  • Concern content that falls under fair dealing or incidental use exemptions,
  • Are abusive, fraudulent, or issued in bad faith.

6. Counter-Notice for Wrongful Copyright Claims

If you believe that a takedown request is wrongful or does not comply with applicable laws, you may submit a counter-notice including:

  • Identification of the content removed or disabled and where it was located before removal,
  • A statement under penalty of perjury that you believe in good faith that the material was removed due to a mistake or misidentification,
  • Your name, address, telephone number, and email,
  • A statement that you consent to the jurisdiction of the courts of England and Wales in case of legal disputes.

7. Legal Consequences of False Claims

We take fraudulent or malicious copyright claims seriously. Under the UK Copyright, Designs and Patents Act 1988, knowingly making false copyright infringement claims may result in:

  • Civil liability for damages, including legal costs,
  • Criminal penalties for perjury under UK law,
  • Legal action against parties misusing copyright claims for monetary gain.

We reserve the right to recover legal fees and damages from entities or individuals filing false or unsubstantiated claims.

8. Jurisdiction & Governing Law

All disputes related to copyright claims shall be governed by the laws of England and Wales. Any legal action must be brought exclusively in UK courts. We do not recognize foreign legal claims that attempt to impose stricter copyright standards than UK law permits.

9. Amendments to This Policy

We reserve the right to modify this policy at any time to reflect changes in law or company practices. Updates will be posted on our website with a revised “Last Updated” date.
